Renter is required to use house sound technician to run sound for any event at a cost of $225.00  A production meeting will be done prior to event with house sound manager. (Basic Sound System Only)

Security Deposit:

  • A $                   deposit is required to confirm a date. A deposit and signed contract must be received for your show to go on sale.
  • The reservation deposit will be retained if your reservation is canceled for any reason.

The Security Deposit may be refunded either in full or part minus any expenses for damages, losses, cleaning expenses, extra rental time, moving and rearranging charges of owner’s furniture & accessories, special contractor charges, unapproved building usage, extraordinary maintenance or repairs and security charges deemed necessary after inspection within ten days after the event. HET will provide detail of the charges against the Security Deposits and any charges in excess of the Security Deposit will be billed to User. Failure to make any attempts to pay additional costs will result in denial of future facility booking requests, attachment of any other security deposits already paid and possible litigation.

  • If for any reason, whether or not beyond the control of the owners, the hall is not available for your event, your sole remedy will be to have all rental fees and deposits refunded to you.

All reservations for private functions are made upon and subject to the rules and regulations of The Historic Everett Theatre (HET) and are subject to the terms and conditions described herein. It shall be the sole responsibility of the User to completely inform their agents, employees, vendors/contractors and guests concerning their obligations under this Agreement. User may have access to house, lobby and restrooms.

This document contains a “hold harmless agreement” that goes into effect immediately after it is signed by all parties.  In addition to this signed document the user must provide proof of insurance.  If the renter does not have insurance, they must pay Theatre $300 in addition to the $             security deposit.   These websites provides insurance information:

Insurance Policies: All insurance policies (except the insurance on Tenant’s personal property) shall name Landlord as additional insured and shall be with companies and with loss-payable clauses satisfactory to Landlord, and copies of policies or certificates evidencing such insurance shall be delivered to landlord by Tenant. No such policy shall be cancelable or amendable except after ten (10) days’ written notice to Landlord

Public Insurance: Tenant, at its own expense shall procure and maintain in effect comprehensive public liability insurance, including contractual liability coverage with limits of not less than $1,000,000 per person, $2,000,000 per occurrence, and $500,000 for property damage; insuring against any and all liability of Tenant with regard to the Premises or use or occupancy thereof. In no event shall the limits of said policies be considered as limiting the liabilities of Tenant under this rental. The above-stated minimum policy limits shall be subject to periodic review by the Landlord.

Overtime/Additional days:

  • All employees are subject to overtime charges after 8 hours. All production crew will be billed at $20 per hour after 8 hours.
  • Additional tech rehearsals, scouting meetings, or any other additional hours or days, not on the rental date, will be billed to your rent at $100 per hour for Theatre.
  • Any additional staffing needed, that is not on the day of show, will be billed at $25 per hour for each staff member.
  • Additional charges may apply for any professional videotaping.

Ticketing:

  • The Historic Everett Theatre is to receive 10 comps for every event, above your capacity.
  • E-Tix is the exclusive ticketing agent for all events at The Historic Everett Theatre. Tickets for your event will be available at The Historic Everett Theatre box office, at etix.com, and charge by phone.
  • A 3% fee will be assessed on all tickets purchased with a credit card at The Historic Everett Theatre Box office for your event.
  • The total balance is due the day of your event.

General Information

  • There is no smoking allowed in the building (theater, lobby, bathrooms, stage, etc…)
  • Any expenses incurred by The Historic Everett Theatre for catering, advertising, backline, barricade, passes, towels, risers, extra staffing, etc. will be added to the rental bill.
  • The Historic Everett Theatre production manager is Brian Olson. All production questions, day of show arrangements, scheduling, etc. must be set up through Brian. He can be reached at 206-852-6992.
  • No open flame of any kind is allowed on the stage or anywhere in The Historic Everett Theatre.
  • There will be an additional $200.00 cleaning charge for any show using confetti or any other substance like confetti.
  • The Historic Everett Theatre requires prior approval for all decorations and banners.
  • The Historic Everett Theatre capacity is 800. Any complimentary tickets issued will reduce this capacity.

CANCELLATION

Either party may cancel this contract up to seven months prior to the event date, in which event the entire Rental Fee shall be refunded in full. The User may cancel this Contract between seven months and three months prior to the event date, in which event fifty percent of the entire Rental Fee is forfeit. If the User cancels within three months prior to the event date, the entire Rental Fee will be forfeited. Incidental charges relating to the execution of the rental agreement will be deducted from any deposits refunded. If HET must cancel this contract prior to the date of the event all Rental Fee and Security Deposit will be refunded.

BUILDING COSTS AND HEATING

The cost of repairing the equipment provided by HET such as, but not limited to; heating and lights, light boards, sound and other equipment that is solely owned by Theatre other equipment on the premises will fall upon the renter that damaged said equipment. All property shall be inspected and signed off on prior to occupancy for each rental period to assure proper working order.

Tenants Obligation to Repair and Maintain. Tenant shall, at its own expense, at all times keep the Premises in good repair and attractive condition and maintained. If the Tenant does not make repairs promptly and adequately, or fails to maintain the Premises in good condition and repair, Landlord may make repairs and Tenant shall pay promptly the reasonable cost thereof. The right of Landlord to make such repairs shall be without prejudice to any rights it may have because of Tenant’s failure to make such repairs,

 

OUTSIDE CONTRACTORS

As a condition of conducting business at HET, all contractors/vendors must meet the standards set forth by the facility, including, but not limited to, supplying proof of license and current insurance. HET must review and approve, in advance of any work performed, all contracts by said contractors/vendors. Deliveries & set up & break down plans must be coordinated within two weeks prior to date of event HET staff.

ADMISSION & PROMOTION

The User is responsible for all reservations and admission to the event. The User is also responsible for all marketing and promotion of the event. HET must give final approval to any and all advertising pertaining to public events held at the Facility. HET will appear in all publicity; the address shall be given, and shall be listed as “The Historic Everett Theatre” and, at least, Theatre’s website MUST be placed on all posters/business cards/flyers that are promoting the show.  The website is:  www.historiceveretttheatre.org

SIGNAGE

Signage: All additions or changes to Tenant’s signage on the exterior of the premises shall be subject to prior written approval by Landlord, and shall be further subject to any rule or government regulation. Landlord also reserves the right to restrict the usage of temporary and/ or permanent window signs and advertisements, and to require their removal, in the event that Landlord determines that the signs or advertisements are offensive, inappropriate or inconsistent with usage of Theatre by other tenants or customers, in the sole judgment of Landlord.

SETUP

HET reserves the right to make adjustments and changes in any setup arrangements for safety or extra cost requirements. The User may not physically alter the existing space. Electrical extension cords must be approved by HET PRIOR TO INSTALLATION. HET allows 4 hours for EXTERIOR set up & take down of rentals included in user’s hourly rate. Time needed beyond that will be billed at $100 per hour. Rates for HET Staff to move or rearrange furniture and accessories or any other needs will be billed at a rate of $25 per man-hour

ENTERTAINMENT

All entertainment, for any form of production, including but not limited to sound, lighting, staging and crew must be approved in advance by HET.

DECORATIONS

HET staff must approve any special decoration needs. No staples, tacks, tape or nails may be used to attach decorations. No paint may be applied. No glitter, confetti, birdseed, or sparklers may be used.

HET will not accept any freight or other delivered items on behalf of the client. Items may not be delivered prior to the contracted move-in time on the event date. Any event that requires set up outside of the contracted hours will result in a $100 per hour charge. Client or client’s representative must be present to accept delivery unless special arrangements have been made and agreed upon in advance with HET staff.

Both parties agree that the Facility will be delivered by HET to User in its “as is” condition. User agrees that its taking possession of the Facility shall be conclusive evidence as against User that the Facility Space was in the condition agreed upon herein.

The responsibilities of the user:

Supervision: The user shall assume full responsibility for the supervision of their activity, as well as the conduct of all attendees and participants. Persons will not be admitted to the facility until an adult supervisor is on site supervisor shall remain with the group throughout the entire use.

Damages: the individual named in the agreement and the group in whose name the agreement is used must accept responsibility for all damage to the property while the group is on-site.

Tobacco, alcohol, weapons: the use of tobacco, alcohol and weapons are not permitted on theater property. (The only exception is a prop weapon that is being used in a performance. The prop weapon must be noted on the rental agreement and be viewed and approved by Theater manager before it is brought into the building.)

Set up: the user is responsible for the setup of the event, under the supervision of Theater staff required for production reparation. The user may not make adjustments to heating, light or furnishings/equipment without prior approval. No decorations or applied creation of material to the walls or floors will be allowed without permission of Theater manager. Theater manager or designee will assist with any items for display.

Access: access will be granted in accordance with the time specified on this used application. With sufficient time to vacate the building at the and time stated on the application. Additional fees may apply for all uses exceeding their permitted schedule.

Performing rights, licenses, and royalties: the user must agree to obtain all necessary performing rights and licenses and pay any applicable royalties other fees as they pertain to the event.

Food and drink's: no food or drinks are permitted on stage, and the makeup room and changing rooms, unless otherwise approved by manager.

Live animals: live animals are not permitted in the facility unless they are a service animal.

Theater restoration

It is the responsibility of the client to restore Theater, backstage area, green room and dressing rooms to the state that it was in before vacating the premises. Should theater staff be required to undertake unusual time and effort to clean and restore the facility and the client will be billed at $25 per hour for this necessary service.

remove everything that belongs to you. Theater will not place into storage and/or be held responsible for security of items left behind without specific written arrangements prior to load in.

CONCESSIONS, ALCOHOL, SWAG AND GENERAL CONCESSIONS

Merchandise:

  • Merchandise rate is 20% Artist sells. We can provide a seller for an extra $75.
  • The Historic Everett Theatre retains the right to serve all food, drink and alcoholic beverages.
  • No outside food or drink is allowed into The Historic Everett Theatre.

ALCOHOLIC BEVERAGES

As the renter, you can decide whether or not you want alcohol served at your event.  If alcohol is to be served Theatre takes any and all profit from sale of the alcohol whether you provide a licensed pourer or not.  Pourers may keep their tips.

It is the responsibility of the User to obey all applicable laws, including but not limited to prohibition of sales to minors and intoxicated persons. All WA State Alcoholic Beverage Commission All laws must be followed while on the premises. Alcoholic beverages must be served by a licensed WA bartender.

Please note:  at this time Washington State Liquor Control Board does not allow alcoholic beverages in a darkened theatre.  This may change in the near future.

Any person under the age of 21 will not be served alcohol under any circumstances. Valid identification is required for guests of a questionable age. Alcohol-only events will not be permitted on the HET property. No alcoholic beverages may be brought in or taken out of the premises by a User or guest. All service staff is required by law to refuse service to any guest who appears to be intoxicated. By signing this agreement, User acknowledges that HET is not liable for persons consuming alcoholic beverages.

SECURITY AND SAFETY

An HET staff person will be on duty during the entire time of the rental. The User is responsible for the conduct and behavior of the group using the facility. Costs for any needed call for security due to unruly behavior during an event by HET will be deducted from security deposit. If this deposit is insufficient to the infraction immediate restitution is required.

HET reserves the right to limit the number of people entering the building or on any floor for safety reasons and crowd & parking control. This includes, but is not limited to:  all hallways, entryways, and aisles.

HET reserves the right to discipline, refuse entry, and/or eject anyone who may be putting themselves or anyone else in harm’s way.

HET and its designees shall have the right to enter the Facility at any time during its use by User.  If HET staff determines that anything is going on that is not appropriate, or unlawful, at any time in any location in Theatre the staff can tell the people to stop and the infraction must stop immediately.  Any designated HET person has this right and their authority must be respected and their decisions adhered to.  If need be, authorities may be contacted.

User, or a guest or other person under the User’s control, shall not engage in any act intended to facilitate criminal activity, including drug-related criminal activity, on or near the Facility.  Weapons are not allowed on the property. Adult supervision of children under the age of 16 is required at all times.

Depending on the type of event, the User may be asked to provide additional security.  If User is anticipating over 300 people for their concert or event – they may be asked to provide TWO additional security personnel.  Since it is the best interest of Theatre to create a safe and enjoyable environment – Theatre can help arrange that security, but the user still has to pay for it.

HAZARDOUS MATERIALS

User shall not cause or permit the storage, use, generation or disposition of any Hazardous Materials (as hereinafter defined) at the Facility without the prior written consent of HET. User agrees to indemnify, defend and hold harmless the HET from all fines, suits, procedures, claims and actions of every kind, and all costs as attorney’s’ and consultant’s’ fees) arising out of or in any way connected with User’s violation of this provision. User’s obligations and liabilities under this Section shall survive the expiration or termination of this Agreement. For purposes of this Agreement, the term “Hazardous Materials” means any explosives, fireworks, radioactive materials or any other hazardous substances.

Indemnification of Landlord

Indemnification of Landlord: Landlord shall not be liable for any loss or injury to persons or damage to property, in or about the Premises, from any cause, which at any time may be suffered by Tenant or by its invitees or employees or agents, except to the extent said damage is caused by the willful misconduct of Landlord, its employees and its agents, harmless from any and all claims and expenses, including reasonable attorney’s fee and costs, and litigation-related expenses arising out of said injury or damage, however occurring, on or about the Premises.

MUSIC

Because HET is located near a residential area, we ask that the decibel level be kept to a reasonable level of 110 decibels at the back of the house from the nearest speaker or sound source and that the music end by midnight. Complaints by neighbors may result in music volume reduction and fines.

COMMON AREAS

Common Areas: Common areas, if any, for use by Tenant, its employees, agents, customer and invitees include parking areas and entrances and exits thereto, driveways and alleyways, sidewalks, landscaped areas and other areas and facilities provided for the common use and benefit of occupants. In many cases this may mean the Balcony and Loge sitting areas depending on type of rental. Landlord reserves the right to exercise reasonable control and management of the common areas and to establish, modify, change and enforce such reasonable rules and regulations as Landlords, in their sole discretion may deem desirable for the management of the Premises or any portion thereof. Landlord shall have the right to close all or any portions of the common areas, balconies and Loge at such times and for such periods as may, in the opinion of the Landlords, be necessary. Landlord may also close said areas for purposes of maintenance and repair as well as Landlord personal use and for the good of Theatre, which would be determined at Landlords sole discretion.

Building Costs and Heating and Air Condition: The cost of repairing the equipment provided by Landlord such as, but not limited to; heating and lights, light boards, sound and other equipment that is solely owned by Theatre  other equipment on the premises will fall upon the renter that damaged said equipment. All property shall be inspected and signed off on prior to occupancy for each rental period to assure proper working order.

CLEAN UP

All food and beverage debris, decorations, supplies and other trash must be picked up, bagged and removed from the property by the User/Contracted Caterer or Bartender. The Facility must be left in an orderly condition. Failure to complete any of these tasks will result in a partial/complete loss of Security Deposit. The HET manager on duty will perform a walk-through of the premises prior to dismissing the caterer.  HET is not responsible for any items left behind by User or its guests and HET may dispose of those at will within 14 days of the event.

Tenant shall, at its own expense, at all times keep the Premises in good repair and attractive condition and maintained. If the Tenant does not make repairs promptly and adequately, or fails to maintain the Premises in good condition and repair, HET may make repairs and Tenant shall pay promptly the reasonable cost thereof. The right of HET to make such repairs shall be without prejudice to any rights it may have because of Tenant's failure to make such repairs.

SURRENDER OF PREMISES

Surrender of Premises: Tenant shall promptly surrender possession of the Premises to Landlord upon the expiration or prior termination of the rental. The Premises shall be surrendered in the same condition as they were at the commencement of the rental term.

INSPECTION & LIABILITY

HET reserves the right to inspect and control all private functions and does not, cannot, and will not assume liability for (1) any personal property or equipment of User or User’s guests or invitees brought to the property, or (2) any injury to User of User’s guests or invitees brought to the property.

USER HEREBY INDEMNIFIES, DEFENDS AND HOLDS The Historic Everett Theater HARMLESS FROM ANY AND ALL CLAIMS, ACTIONS, DAMAGES, LIABILITIES, COSTS AND EXPENSES BY ANY PARTY, INCLUDING GUESTS OF USER, ARISING OUT OF ANY SUCH EVENT.

Accidents must be immediately reported in writing to the HET at the address stated above and in any event within 24 hours. User agrees to immediately deliver to the HET at the address stated above every process, pleading or paper relating to any claims or proceedings arising out of any accident involving the Facility. The User shall not aid any claimant but shall cooperate fully with HET in manners connected with any claims or suits.

HET shall not be liable for any loss or injury to persons or damage to property, in or about the Premises, from any cause, which at any time may be suffered by Tenant or by its invitees or employees or agents, except to the extent said damage is caused by the willful misconduct of  HET, its employees and its agents, harmless from any and all claims and expenses, including reasonable attorney's fee and costs, and litigation-related expenses arising out of said injury or damage, however occurring, on or about the Premises.

USER AGREES THAT AS PART OF THE TERMS OF THIS AGREEMENT USER ON BEHALF OF HIMSELF/HERSELF/ITSELF AND HIS/HER/ITS GUESTS, HEIRS, EXECUTORS, THEATRE ADMINISTRATORS, ASSIGNS AND LEGAL REPRESENTATIVES AGREES TO INDEMNIFY AND HOLD HARMLESS THE HISTORIC EVERETT AND ITS OWNERS, OFFICERS, REPRESENTATIVES AND EMPLOYEES FROM ANY AND ALL DAMAGES OR LIABILITY ARISING IN CONNECTION WITH OR RELATED TO RENTAL OF THE FACILITY, EXCEPT WHERE SUCH DAMAGES ARE CAUSED SOLELY BY THE ACTIONS OF HET

User agrees to obtain and maintain throughout the term of the event, insurance of such types and in such amounts as a reasonably prudent company would obtain and, upon request, agrees to the evidence of such insurance. User agrees to obtain and maintain throughout the term of the event, proof of insurance from each vendor or contractor conducting business at HET, indicating HET as an additionally insured for the duration of the event including set-up and tear-down times. This proof of insurance must be supplied to HET facility staff no later than two weeks prior to the event.  HET is covered by general liability insurance, but will not be responsible for the User’s guests, members, personnel, equipment, properties, or audience. User assumes all responsibility when signing this agreement.   Please see page 1 in regards to Insurance.

TERMINATION/DAMAGES

Should User be found in violation of any of the provisions of this Rental Agreement, HET shall have the option, in its sole discretion to terminate the Agreement and User will forfeit all payments previously made to HET and shall remain liable for all rental fees and other expenses including legal fees incurred, whether or not the event actually occurs. Additionally, future events scheduled at facilities operated by HET may be cancelled at the sole discretion of the HET.

If User leaves personal belongings or items pertaining to event at the Facility, HET may charge for additional rental time and/or labor and storage costs of such items and HET may dispose of those at will within 14 days of the event.

HET staff will inspect for damages and clean-up prior to departure and within 10 days after usage. Damage to the facility or equipment shall be paid for in full by the person or group signing this Agreement. User is responsible for damages to the building, furniture and equipment caused by the User or anyone associated with User’s use of building.

In addition to anything else provided herein, User expressly agrees to pay to HET on demand:

(a) Any fine or legal violation, including administrative fees, against User during the term of this Agreement, or against HET to the extent arising out of or relating to the renting of the Facility to User.

(b) All expenses incurred by HET in connection with the collection of monies due HET pursuant to this Agreement or in enforcing any term or condition of this Agreement, including all attorney’s fees, administrative fees and costs.

(c) All costs of repairing any damage to the Facility.

(e) $50.00 per hour cleaning fee if the Facility is returned in not substantially the same condition in which it was issued.

(f) $25 per hour per man hour for moving furniture or accessories at User’s request before and after event

The rights and remedies provided in this Agreement are cumulative, and the use of any one right or remedy by HET shall not preclude or waive its right to use any or all other remedies.

The rights and remedies provided in this Agreement are given in addition to any other rights the parties may have by law, statute, ordinance, or otherwise.

NON-TRANSFERABILITY

Facility rentals made to a particular User are made exclusively for that User. User shall not have the right to assign its rights or obligations under this Agreement without the prior written consent of HET. If the User relinquishes a date, the date reverts to HET and the scheduling of a new rental date becomes subject to general scheduling availability.

MISCELLANEOUS

This Agreement shall be construed under and in accordance with the laws of the State of WA, and all obligations of the parties created by this Agreement are performable in Snohomish County. If this agreement is signed in the name of a corporation, partnership, association, club or society, the person signing represents and warrants to HET that he/she has the authority to bind such entity and that such party will be personally liable for the faithful performance of this contract.

This Agreement constitutes the sole and only agreement of the parties and supersedes any prior understandings or written or oral agreements between the parties.

No amendment, modification, or alteration of the terms of this Agreement shall be binding unless it is in writing, dated subsequent to the effective date of this Lease, and duly executed by the parties hereto.

USER AGREES BY HIS/HER SIGNATURE ON THE FACE HEREOF THAT HE/SHE HAS READ AND IS AWARE OF THE TERMS AND CONDITIONS CONCERNING THE USE OF THE FACILITY AND ACCEPTS FULL RESPONSIBILITY HEREIN.

This agreement is between the Everett Theatre Society (Historic Everett Theatre)  (hereinafter called HET), a Washington non-profit corporation, and _____(hereinafter called Renter) in regards to the rental of The Historic Everett Theater located at 2911 Colby Ave., Everett, WA 98201.   HET and Renter recognize this Agreement as a binding contract under the civil codes of Snohomish County, Washington.

 

GENERAL INFORMATION/ BASIC RATES

The facility is available for rent on a daily basis between the hours of ______ and 11:59 p.m.   The time of use specified on this Agreement is the only time the Renter is authorized to be in the facility.  All hours must run consecutively from arrival to exit, within the hours rented. 

 

  1. Renter agrees to pay a base rental rate of $  ___for the use of the building.  A non-refundable deposit equal to 50% of the base rental rate is required to secure the dates.  Deposit is due at time contract is signed unless otherwise noted.
  2. The remainder of the rental fee is due on the date of the performance/presentation/event. The event may not proceed until payment is received in full.
  • Renter agrees to additionally pay HET fees for cleaning plus reimburse HET for any staffing.
  1. Technical requirement for lighting, sound and staging are required two weeks prior to the rental date. In the event that renter wishes to use HET lighting and sound technicians and additional fee will be charged for each tech. Fee to be $12 to $25 dollars an hour depending on extend of usage.
  2. HET reserves exclusive right to distrubute promotional material within the theatre; relevent to HET or its Renter’s and to operate house concession areas, to sell foods, beverages, HET merchandise and HET memberships to Renter patrons, and to retain all revenues from sales of such products and services.
  3. Renter is allowed to set up display and/or sales tables for its own merchandise or marketing. Renter is responsible for any and all taxes imposed on those sales.              
  • Renter is responsible for set‑up of their own equipment/sets; and removal of all items in stage and greenroom areas immediately after performance.
  • HET reserves 20 complimentary tickets to each show to be used for HET promotions, donors, supporters and/or staff.
  1. In the event that the production has a percentage split between artist and venue then settlement will be after ticket vendor has deposited money into venue account. Usually 4 to 5 days.
  2. In the event a social groups are used to sell tickets (Groupon, Living Social etc..) Then monies will be disbursed upon those agencies depositing money into venue account.

 

LICENSES AND PERMITS

  1. Renter will provide at its cost any special permits or licenses required for its event or performance, and will present proof of same to HET.

 

 INSURANCE

  • Renter is required to provide proof of liability insurance to cover Renter’s personnel, equipment, audience and damage to building caused by Renter or its agents. Insurance certificate must name the Everett Theatre Society dba the Everett Theatre Group, its directors and staff as Additional Insureds with respect to all activities by Renter held on the premises of the Everett Theatre.
  • PROOF OF INSURANCE MUST BE RECEIVED BY HET NO LATER THAN FIVE (5) DAYS BEFORE THE RENTAL DATE. Policy must also provide for 10-day notice to HET prior to cancellation of policy.

 

STORAGE/REMOVAL OF PROPERTIES

  • Properties, materials and equipment of Renter must be removed from facility immediately following performance. Any properties, materials or equipment left in the building without the specific consent of HET Building Manager becomes the property of HET and may be disposed of at the discretion of HET.
  1. HET is not responsible for any loss or damage to Renters equipment, materials or properties.

 

CANCELLATION/POSTPONEMENT OF EVENT

  • Renter may cancel or postpone its event with the following stipulations:
  1. If canceled at least three months in advance, the Renter's total deposit will be refunded with the exception of $250.00 administration fee.
  2. If canceled less than three months in advance Renter forfeits its deposit in full.
  3. Renter may postpone its event with a minimum two weeks notice, pending an available date, although deposit will continue to be held by HET.
  4. Exceptions due to extenuating circumstances may apply.
  • HET reserves the right to cancel the scheduled event under the following circumstances:
  1. This agreement is found to contain false or misleading information.
  2. The Renter or its agents willfully or through negligence mistreats the facility, staff or equipment.

MISCELLANEOUS

  • This Agreement, together with the Statement of Rental Fees & Policies and any attachments incorporated herein, constitute the entire agreement between the parties and cannot be modified except by written agreement by both parties.
  • The Historic Everett Theatre is a no‑smoking facility. Those not complying with this restriction may be ejected from the facility.
  1. It is understood that the Renter is an independent contractor. Any and all forms of insurance and/or payroll liabilities for Renter's personnel (including those provided by HET at Renter's request) are the responsibility of the Renter.
  • Renter will be allowed to use available space on stage, there will be times when HET will have set and other materials on the left and right wings and back wall of the stage area. Renter will not move or touch these items for any reason without permission from HET representative.
  • RENTER HAS INSPECTED FACILITY AND AVAILABLE EQUIPMENT.
